The Biotechnology Innovation Organization IP Counsels Committee will be offering the next installment in its webinar series on November 10, 2021 at 3:00 pm (EDT). In the webinar, entitled "Accepting the Status Quo: Subject Matter Eligibility Nearly a Decade after Mayo," Kevin Noonan and Donald Zuhn Jr. of McDonnell Boehnen Hulbert & Berghoff LLP will moderate a panel consisting of Cara Coburn of Genentech, June Cohan of the U.S. Patent & Trademark Office, and Derek Maetzold of Castle Biosciences, Inc. The panel will discuss how almost a decade after the Supreme Court's decision in Mayo v. Prometheus, the current subject matter eligibility standard has become the status quo with little prospect for change. The panel will also discuss how innovators can best protect their technology under these circumstances, how subject matter jurisprudence has impacted the patent process, and whether incremental changes could improve the situation.
