Declaratory judgment of invalidity and non-infringement of U.S. Patent Nos. 6,651,816 ("Antihistamine Decongestant Regimens for Treating Rhinitis," issued November 25, 2003) and 6,843,372 (same title, issued January 18, 2005) based on Breckenridge's sale of certain Allergy DN products, products comparable to certain of Cornerstone's AlleRx® formulations (used to treat allergies and symptoms of the common cold). Infringement of U.S. Patent No. 5,756,506 ("Single High Dose Fluoroquinolone Treatment," issued May 26, 1998) following the equivalent of a Paragraph IV certification as part of Norbrook's filing of its ANADA (Abbreviated New Animal Drug Application) to manufacture a generic version of Bayer's BAYTRIL® 100 (enrofloxacin injection, used for the treatment of bovine respiratory disease in beef and non-lactating dairy cattle).
