why oh why is no group suggesting dropping the duty of disclosure? Lets go the EPO way, let the PTO do the search for what is relevant. This inequitable conduct-1.56 trap is getting ridiculous

Speaking of which, anyone think that perhaps a large percentage of the backlog is caused by Examiners that either of their own volition or because of mandates from above mail our ridiculous restriction requirements (I once got a 4 quadrillion way restriction requirement in a case) and intentionally fail to interpret terms consistent with how OOSA would interpret them after review of the specification? When we have to spend 3 amendments arguing about what a "phenotype" is, then the system is broke, and it's from within.

The system is broken, and the real problem is that noone at the Patent Office has ever practiced patent law, thus they know not what they do...and they reinforce each other in the blame game - it ain't us, it is THEM!

The inmates are running the asylum. Funny in "One Flew Over the Cuckoo's Nest", but not so much here.
