The American Bar Association (ABA) Section of Intellectual Property Law, Section of Science and Technology Law, and Center for Professional Development will be offering a live webinar and teleconference entitled "Single Claim Restriction Requirements: The Interplay Between 35 USC § 112 and 35 USC § 121" on October 2, 2012 from 12:00 - 1:30 pm (Eastern). Dr. Keisha Hylton-Rodić of Drinker Biddle & Reath LLP will moderate a panel including Thomas L. Irving of Finnegan, Henderson, Farabow, Garrett & Dunner, LLP and Dr. Orlando Lopez of Burns & Levinson LLP. The panel will examine the balance between 35 USC § 112 and 35 USC § 121, and their interplay in the context of single claim restriction requirements, as exemplified in Ex Parte Degrado, and address the tactics that can be used during prosecution to avoid the pitfall of single claim restrictions in chemical and biotech cases in contravention of current case law on the practice.
